Terms & Conditions

Welcome to Black Yak Adventure, a premier, licensed trekking and expedition company based in Gilgit-Baltistan, Pakistan. These Terms & Conditions govern your use of our website and all bookings, tours, treks, mountain expeditions, and alpine services provided by us.

By accessing our website or booking any mountain excursion with us, you confirm that you have read, understood, and agreed to these Terms & Conditions.

1. Booking & Contract Activation

  • Confirmation: A booking is officially confirmed once we receive your required advance deposit or full payment, and you receive a written confirmation from Black Yak Adventure via email or WhatsApp.
  • Group Bookings: By booking on behalf of family, friends, or a climbing team, you confirm that you possess the legal authority to accept these Terms & Conditions on their behalf.
  • Data Accuracy: All participants must provide precise passport details and personal information required for Pakistan Visa invitation letters (LOIs), Central Karakoram National Park (CKNP) permits, trekking registrations, and high-altitude logistics.

2. Payments & Transparent Pricing

  • Currency: All tour prices are quoted in USD or EUR. Prices are subject to adjustment before your booking is officially confirmed due to shifting local permit costs.
  • Deadlines: A secure deposit is mandatory to lock in your trekking dates. The remaining balance must be paid in full by the specific deadline outlined in your confirmation invoice.
  • Security: Payments are securely processed via verified third-party global payment gateways. We do not store credit or debit card details.
  • Transaction Fees: Any international bank transfer fees, currency conversion spreads, or third-party processing charges are the responsibility of the client.

3. Cancellations & Refund Policy

By the Client

  • Specific cancellation timelines will be clearly stated on your initial tour invoice.
  • Due to advance logistical arrangements—including booking domestic flights to Skardu, purchasing food rations, and securing high-altitude porter teams—deposits are non-refundable. However, they are fully transferable to the next two consecutive trekking seasons.
  • Partial refunds of the remaining balance may apply depending on your notice period and non-recoverable costs already incurred by us.

We reserve the right to cancel, delay, or modify any mountain itinerary due to:

  • Extreme Karakoram weather or avalanches.
  • Natural disasters or sudden terrain hazards.
  • Shifting political, civil, or security conditions in the region.
  • Unexpected health emergencies or sudden local governance changes.

In these rare circumstances, we will provide you with a choice of: an alternative route of equal value, rescheduling your expedition entirely, or a partial to full refund (excluding non-recoverable vendor costs).

4. Adaptive Itinerary Changes

  • Mountain Realities: Adventure travel in remote regions like the Baltoro Glacier, Hunza Valley, or Hindukush involves inherent unpredictability. We reserve the right to adjust routes on the ground to ensure group safety, health, and operational fluidity.
  • Exclusions: No partial refunds or compensation will be issued for itinerary changes forced by bad weather, acute mountain sickness (AMS), physical fitness limitations, missed domestic flights, or sudden government travel restrictions.

5. Mandatory High-Altitude Travel Insurance

  • Strict Policy: Comprehensive adventure travel insurance is strictly mandatory for every participant joining a Black Yak Adventure expedition.
  • Required Coverage: Your insurance policy must explicitly cover:
    • High-altitude trekking up to $6,000\text{m}$ (or higher for mountaineering peaks).
    • Emergency helicopter evacuation, rescue services, and field hospitalization.
    • International medical expenses, trip interruptions, and baggage loss.
  • You must submit official proof of your active insurance policy before we depart from Skardu or Islamabad.

6. Health, Physical Fitness & Personal Responsibility

  • Preparation: Trekkers are solely responsible for ensuring they are physically conditioned and mentally prepared for high-altitude trekking in Gilgit-Baltistan.
  • Medical Disclosure: You must openly disclose any pre-existing medical conditions, severe allergies, or chronic health issues prior to booking.
  • Field Authority: To protect the safety of the group, Black Yak Adventure reserves the absolute right to remove any participant from a trek if our lead guide deems their physical or mental health a safety risk to themselves or others.

7. Visas, Permits & Legal Documentation

  • While we provide expert guidance and sponsorship documents, you are entirely responsible for securing a valid international passport and an official Pakistan Tourist or Trekking Visa.
  • We are not held liable for trip cancellations, financial losses, or itinerary delays caused by incomplete documentation, late submissions, or visa rejections by government authorities.

8. Assumption of Inherent Risk

By booking an alpine journey into the Karakoram, Himalaya, or Hindukush ranges, you explicitly acknowledge and accept that wilderness travel involves serious inherent risks. These include, but are not limited to: acute mountain sickness (AMS), extreme drop-offs in temperature, challenging glacial terrain, rockfalls, and limited or delayed access to emergency medical facilities. You agree to travel entirely at your own responsibility.

9. Liability Limitations

  • Black Yak Adventure operates with the highest safety standards, but shall not be held liable for personal injury, illness, psychological trauma, or death, nor for the loss, theft, or damage of personal gear and climbing equipment.
  • Our maximum financial liability is strictly limited to the net amount paid to us for your specific tour package.

10. Force Majeure

We are legally exempt from liability or failure to perform our contractual services if the interruption is caused by events completely beyond our control, including acts of God, war, civil unrest, pandemics, or sudden border closures.

11. Media, Photography & Marketing

  • Our team frequently captures high-quality photographs and videos during our expeditions. By traveling with us, you grant Black Yak Adventure permission to use this media for promotional and marketing purposes.
  • If you prefer to keep your image completely private, simply inform us in writing prior to starting your tour.

12. Privacy & GDPR Compliance

Your personal details are completely safe with us. We process all private information in strict accordance with global data protection standards (GDPR compliant) and only share data with local authorities when required for processing official trekking permits.

13. Governing Law & Legal Jurisdiction

These Terms & Conditions are governed entirely by the federal laws of Pakistan. Any legal disputes or claims arising from our services shall be subject to the exclusive jurisdiction of the courts of Pakistan.

14. Continuous Amendments

Black Yak Adventure reserves the right to update or refine these Terms & Conditions at any time to align with new safety protocols or government regulations. All updates will be published instantly on this page.
